BIKE Bellingham – Terms of Use & Liability Waiver

Welcome to BIKE Bellingham, a program operated by Curioocity LLC (“Company,” “we,” or “us”).

1. Acceptance of Terms

By accessing or using the BIKE Bellingham website, downloading or viewing any ride guide, scanning any QR codes, or clicking “I Agree,” “Accept,” or similar acknowledgment, you (“User”) agree to be legally bound by these Terms of Use and Liability Waiver (“Terms”). If you do not agree to these Terms, you must not use the website or any Content. These Terms constitute a binding agreement under the laws of the State of Washington.

2. Nature of Services

BIKE Bellingham provides free themed downloadable digital ride guides connecting cyclists with Bellingham’s culture, heritage, landscape, and businesses. The ride guides include maps, navigation, and related information (collectively, the “Content”) for informational and recreational purposes only.

3. No Warranties

ALL CONTENT IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW IN Washington, CURIOOCITY LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Accuracy, completeness, or reliability
Safety or suitability of any route
Current or future conditions of roads, trails, traffic, weather, or facilities

4. Assumption of Risk

Bicycling involves inherent risks, both foreseeable and unforeseeable, including but not limited to collisions, road hazards, weather conditions, equipment failure, and the actions of others. By using the Content, you:

Voluntarily assume all risks, known and unknown
Accept full responsibility for your safety and decisions
Acknowledge that conditions may change at any time

5. User Responsibilities

You agree that you are solely responsible for:

Determining whether a route is appropriate for your skill and fitness level
Inspecting and maintaining your equipment
Wearing appropriate safety gear, including helmets
Complying with all applicable laws and regulations
Following all traffic laws and regulations, which take precedence over any Content provided

6. Release and Waiver of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW IN Washington, YOU, ON BEHALF OF YOURSELF AND YOUR HEIRS, PERSONAL REPRESENTATIVES, AND ASSIGNS, RELEASE, WAIVE, AND DISCHARGE CURIOOCITY LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, CLIENTS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, OR CAUSES OF ACTION, INCLUDING THOSE ARISING FROM NEGLIGENCE, RELATED TO:

USE OR MISUSE OF THE CONTENT
ERRORS OR OMISSIONS IN MAPS OR ROUTES
CHANGED CONDITIONS AFTER PUBLICATION
PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE

7. Indemnification

You agree to defend, indemnify, and hold harmless Curioocity LLC and its members, employees, contractors, clients, and affiliates from and against any and all claims, liabilities, damages, and expenses (including attorneys’ fees) arising out of:

Your use or misuse of the Content
Your violation of these Terms
Claims brought by third parties related to your actions

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW IN Washington:

CURIOOCITY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES
CURIOOCITY LLC SHALL NOT BE LIABLE FOR ANY CLAIMS ARISING FROM:
- INACCURATE OR OUTDATED INFORMATION
- USER DECISIONS OR BEHAVIOR
- THIRD-PARTY ACTIONS
TOTAL LIABILITY SHALL NOT EXCEED ZERO DOLLARS ($0.00), AS THE CONTENT IS PROVIDED FREE OF CHARGE

9. Governing Law and Venue

These Terms shall be governed by the laws of the State of Washington. Any legal action shall be brought exclusively in the courts located within the State of Washington.

10. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

11. Affirmative Acknowledgment

You have read and understand these Terms
You agree to be legally bound by them
You knowingly and voluntarily assume all risks associated with bicycling
