BIKE Bellingham – Terms of Use & Liability Waiver

Welcome to BIKE Bellingham, a program created and offered by Curioocity LLC (“Company,” “we,” or “us”).

1. Acceptance of Terms

By accessing or using the BIKE Bellingham website, downloading or viewing any ride guide, scanning any QR codes, or clicking “I Agree,” “Accept,” or similar acknowledgment, you (“User”) agree to be legally bound by these Terms of Use and Liability Waiver (“Terms”). “Content” means all materials available on or through the BIKE Bellingham website, including but not limited to text, photographs, graphics, maps, route descriptions, downloadable ride guides (including those provided through Ride with GPS), ride itineraries, and other materials.

If you do not agree to these Terms, you must not use the website or any Content. These Terms constitute a binding agreement under the laws of the State of Washington.

2. Changes to Terms

This Terms of Use & Liability Waiver may be revised from time to time. Any revisions will be updated on this page and become effective upon posting unless otherwise stated. By continuing to access or use this website, downloading or viewing any ride guide, scanning any QR codes, or clicking “I Agree,” “Accept,”or similar acknowledgment after the revised Terms are posted, you agree to be bound by the updates.

3. Nature of Services

BIKE Bellingham provides free themed downloadable digital ride guides connecting cyclists with Bellingham’s culture, heritage, landscape, and businesses. The ride guides include maps, navigation, and related information for informational and recreational purposes only.

4. Intellectual Property and Permitted Use

All Content on the BIKE Bellingham website is owned by Curioocity LLC or licensed for use by BIKE Bellingham and is protected by applicable copyright and intellectual property laws. The Content is provided for your personal, non-commercial use. You may not copy, reproduce, modify, republish, distribute, display, transmit, create derivative works from, or otherwise use any Content—including downloadable ride guides—for promotional, commercial, or public purposes without the prior written authorization from Curioocity LLC. Nothing in these Terms grants you any ownership or license rights in the Content except for the limited right to access and use it for personal, non-commercial purposes. Requests for permission to use BIKE Bellingham Content should be submitted in writing through the contact information provided on this website.

5. User Responsibilities

You agree that you are solely responsible for:

Determining whether a route is appropriate for your skill and fitness level
Inspecting and maintaining your equipment
Wearing appropriate safety gear, including helmets
Complying with all applicable laws and regulations
Following all traffic laws and regulations, which take precedence over any Content provided

6. Assumption of Risk

Bicycling involves inherent risks, both foreseeable and unforeseeable, including but not limited to collisions, road hazards, weather conditions, equipment failure, and the actions of others. By using the Content, you:

Voluntarily assume all risks, known and unknown
Accept full responsibility for your safety and decisions
Acknowledge that conditions may change at any time

7. No Warranties

ALL CONTENT IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW IN Washington, CURIOOCITY LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Accuracy, completeness, or reliability
Safety or suitability of any route
Current or future conditions of roads, trails, traffic, weather, or facilities

8. Release and Waiver of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW IN Washington, YOU, ON BEHALF OF YOURSELF AND YOUR HEIRS, PERSONAL REPRESENTATIVES, AND ASSIGNS, RELEASE, WAIVE, AND DISCHARGE CURIOOCITY LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, CLIENTS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, OR CAUSES OF ACTION, INCLUDING THOSE ARISING FROM NEGLIGENCE, RELATED TO:

USE OR MISUSE OF THE CONTENT
ERRORS OR OMISSIONS IN MAPS OR ROUTES
CHANGED CONDITIONS AFTER PUBLICATION
PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW IN Washington:

CURIOOCITY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES
CURIOOCITY LLC SHALL NOT BE LIABLE FOR ANY CLAIMS ARISING FROM:
- INACCURATE OR OUTDATED INFORMATION
- USER DECISIONS OR BEHAVIOR
- THIRD-PARTY ACTIONS
TOTAL LIABILITY SHALL NOT EXCEED ZERO DOLLARS ($0.00), AS THE CONTENT IS PROVIDED FREE OF CHARGE

10. Indemnification

You agree to defend, indemnify, and hold harmless Curioocity LLC and its members, employees, contractors, clients, and affiliates from and against any and all claims, liabilities, damages, and expenses (including attorneys’ fees) arising out of:

Your use or misuse of the Content
Your violation of these Terms
Claims brought by third parties related to your actions

11. Governing Law and Venue

These Terms shall be governed by the laws of the State of Washington. Any legal action shall be brought exclusively in the courts located within the State of Washington.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
